Application of Fair Use

While LinkTransform offers plans advertised as "unlimited" (including unlimited links, unlimited clicks, unlimited QR codes, unlimited tracking, and other unlimited features), all services are subject to this Fair Use Policy. "Unlimited" means that there are no predetermined fixed limits for typical business or personal use. However, the Service is intended for normal, reasonable use patterns and is not designed to support extreme, excessive, or abusive usage that falls outside the scope of ordinary business or personal purposes.

This Fair Use Policy ensures that all users have equitable access to high-quality, reliable service and prevents individual users from negatively impacting system performance, availability, or service quality for others.

What Constitutes Fair Use

Fair use is defined as usage patterns consistent with typical business or personal needs for link management, QR code generation, BioPage creation, and file link sharing. This includes reasonable volumes of:

  • Link creation and management for legitimate business or personal purposes

  • Click and scan tracking for standard marketing, communication, or organizational needs

  • Data storage and analytics access appropriate to the user's stated business purpose

  • API calls and integrations that align with normal operational requirements

  • Feature usage that does not strain or compromise system resources

Unreasonable and Excessive Use

We reserve the right to determine, in our sole discretion, what constitutes unreasonable, excessive, or abusive use. Examples of use that may be deemed excessive or unreasonable include, but are not limited to:

  • Creating links, QR codes, or BioPages at volumes significantly exceeding typical usage patterns for accounts of similar type and size (e.g., 100 times or more above the average usage of comparable accounts)

  • Generating automated traffic or artificial clicks designed to inflate analytics metrics

  • Using the Service for resale, redistribution, or white-label purposes without authorization

  • Operating multiple accounts to circumvent usage monitoring or this policy

  • Engaging in continuous, sustained high-volume usage that monopolizes system resources

  • Using the Service in a manner that degrades performance or availability for other users

  • Implementing automated systems or bots that create excessive server load

  • Storing or transferring unusually large files that exceed reasonable expectations for link management services

  • Conducting stress testing, benchmarking, or competitive analysis without prior written permission

  • Using the Service as a primary data storage or content delivery network beyond its intended purpose

Monitoring and Enforcement

We actively monitor usage patterns, system performance, and resource consumption to identify potential violations of this Fair Use Policy. Our monitoring may include, but is not limited to:

  • Link creation volumes and frequency

  • Click and scan volumes and patterns

  • Data storage consumption

  • API call frequency and volume

  • Bandwidth and server resource utilization

  • Unusual traffic patterns or anomalies

If we determine, in our sole discretion, that your usage violates this Fair Use Policy, we reserve the right to take any or all of the following actions:

Initial Contact: We will attempt to contact you using the contact information associated with your account to discuss your usage patterns and determine whether your use case requires a different service plan or custom solution.

Temporary Restrictions: We may temporarily limit, throttle, or restrict certain features or functionality to bring your usage into compliance with fair use standards while we work with you to resolve the issue.

Plan Modification: We may require you to upgrade to a higher-tier plan, purchase additional capacity or resources, or migrate to a custom enterprise plan designed to accommodate your usage levels.

Overage Fees: We may implement overage charges or usage-based fees for consumption that exceeds fair use thresholds, with such fees to be determined based on actual resource costs and operational impact.

Service Suspension: If you do not respond to our communications, refuse to modify your usage patterns, or decline to upgrade to an appropriate plan, we may suspend your account and services until the matter is resolved.

Account Termination: We reserve the right to terminate your account immediately if your usage poses security risks, compromises system integrity, significantly impacts other users, or if you repeatedly violate this Fair Use Policy after being notified.

Right to Modify Policy

We reserve the right to modify this Fair Use Policy at any time to address evolving usage patterns, technological changes, system capacity, or business requirements. Modifications to this policy will be communicated according to the notice provisions in these Terms and Conditions. Continued use of the Service after policy modifications constitutes acceptance of the revised Fair Use Policy.

We may also implement technical measures, rate limiting, usage caps, or other restrictions as necessary to enforce this policy and maintain service quality for all users.

No Guaranteed Service Levels for Excessive Use

Service level agreements, uptime guarantees, and performance commitments apply only to usage that complies with this Fair Use Policy. We do not guarantee any specific service levels, response times, or system availability for usage patterns that exceed fair use thresholds or are determined to be excessive.

Cooperation and Communication

We encourage open communication regarding usage needs. If you anticipate usage patterns that may exceed typical levels, or if you have legitimate business requirements for high-volume usage, please contact us in advance to discuss custom solutions, enterprise plans, or dedicated infrastructure options designed to support your specific needs without impacting other users.

No Waiver of Rights

Our failure to enforce this Fair Use Policy in specific instances does not constitute a waiver of our right to enforce it in the future. Each violation may be addressed independently, and past tolerance of certain usage patterns does not create any obligation to continue allowing such usage.
